Article I. Nuisance Control

The city of Maywood Park adopts, subject to the following exceptions, alterations and modifications, Multnomah County (Oregon) Ordinance No. 125, a copy of which, marked as Exhibit “A,” is attached hereto and by this reference, save said exceptions, alterations, and modifications, is incorporated herein.

A. The words “Multnomah County Nuisance Control Ordinance” are deleted and wherever such words are used, they shall be deemed to mean “Maywood Park Nuisance Control Ordinance.”

B. The words “board of county commissioners” are deleted and, wherever such words are used, they shall be deemed to mean “city council.”

C. Section 4 of Multnomah County Ordinance No. 125 is amended so as to provide that the word “director” shall be deleted, and wherever such word is used it shall mean “city council.” Notwithstanding this provision, the city council may delegate its enforcement authority to representatives of Multnomah County, including the director of the department of environmental services of Multnomah County or his or her authorized representative.

D. The words “health officer” shall be deleted and, wherever such words are used, they shall be deemed to mean “city planning commission.” Notwithstanding this provision, the city council may delegate such authority as is granted under Multnomah County Ordinance No. 125 to the Multnomah County health officer.

E. It is hereby declared to be a violation of this article for any owner, tenant, possessor, licensee, or occupier of any land or improvement located within the city of Maywood Park to use such land or improvement for the purpose of conducting any business or activity therein or thereon offensive to the residential character of the area within the incorporated limits of Maywood Park. Auto, truck, cycle, or vehicular repair or services conducted for compensation of any kind, or any auto, truck, cycle, or vehicular repair other than by the owner of such vehicle or by the members of the owner’s immediate family, except such repairs or services as are reasonably necessary to keep the vehicle of the owner or the vehicle of his immediate family in a good state of repair, are deemed to be offensive to the residential character of the area within the corporate limits of Maywood Park.
